Understanding Legislation - The German Supply Chain Act in a Nutshell

Hinweis: Die neu gewählte Bundesregierung hat in ihrem Koalitionsvertrag vom 9. April 2025 festgehalten, dass sie das Lieferkettensorgfaltspflichtengesetz (LkSG) in der kommenden Legislaturperiode abändern will. Es wird erwartet, dass die Bundesregierung die geplanten Änderungen durch eine Gesetzesänderung oder eine untergesetzliche Weisung an das Bundesamt für Wirtschaft und Ausfuhrkontrolle (BAFA), umsetzen wird. Vorgesehen ist laut Koalitionsvertrag, die Berichterstattung nach dem LkSG auszusetzen und - mit Ausnahme von „massiven Menschenrechtsverletzungen“ - keine Sanktionen zu verhängen. Abgesehen von der geplanten Anpassung der Berichterstattung und Sanktionierung wird das LkSG voraussichtlich, wie im Webinar beschrieben, weiterhin Bestand haben. Langfristig strebt die Bundesregierung an, das LkSG durch ein Gesetz zur Umsetzung der CSDDD zu ersetzen.

Disclaimer: The newly elected German government has stated in their coalition agreement from April 9, 2025, that they aim to amend the German Supply Chain Due Diligence Law (LkSG) during the upcoming legislation. The Federal Government is expected to implement the planned changes by means of an amendment to the law or a sub-legislative instruction of the responsible state authority, the Federal Office for Economic Affairs and Export Control (BAFA). The plan is to suspend reporting under the LkSG and - with the exception of ‘massive human rights violations’ - not to impose any sanctions. Apart from changes to reporting and sanctions, the LkSG is likely to continue as outlined in the webinar recording. In the long run, the government aims to replace the LkSG with a law implementing the CSDDD.
